A divorce and a property settlement are two different and separate legal processes.

You do not necessarily need to finalise your property settlement before applying for a divorce. However, the time limit for commencing a property settlement commences once your divorce application or order becomes effective. Therefore, our solicitors recommend finalising your property settlement before filing a divorce application.
